Shipping policy

Introduction

These Terms of Sale apply to all consumer purchases of physical goods from TheMF LCC (operating via the domain themystery.fun) made over the Internet. These terms are not intended to limit any consumer rights mandated by applicable law, but to outline the key rights and obligations of both the seller and the buyer in a purchase. (Note: The business operates worldwide, is based in Wyoming, USA, and all terms are provided in English.) Unless otherwise stated, all sales are final (no refunds or returns) except as required by law (such as the legal right of withdrawal or remedies for defective products).

1. The Agreement

The purchase agreement consists of these Terms of Sale, together with the information provided in the online ordering process (product details, price, shipping costs, etc.), and any specific terms separately agreed between the parties. In case of conflict, any individually agreed terms will take precedence as long as they do not violate mandatory law. The agreement is additionally governed by relevant legal provisions on consumer sales. By placing an order, the buyer confirms that they are legally capable of entering into this agreement (typically, 18 years or older, or with parental consent if a minor).

2. The Parties

  • Buyer: The buyer is the consumer who places an order for goods from the seller’s website, herein referred to as “the buyer.” The buyer is the individual end-user purchasing for personal, non-commercial use (unless otherwise agreed).

3. Price

The purchase price for the goods is the total amount the buyer must pay, including all applicable taxes and mandatory fees. All prices are listed in United States Dollars (USD) by default. This price includes all taxes and additional costs, and no additional charges will be added that the seller did not inform the buyer of before purchase. Shipping costs (if any) or other fees will be clearly shown during checkout.

For international orders: The buyer is responsible for any import duties, customs fees, or local taxes that are not collected at checkout. Such import-related charges (if applicable) are levied by the destination country and are not included in the price paid to the seller.

4. Conclusion of Agreement

A binding agreement is formed between the parties once the buyer submits an order at themystery.fun and the order is received by the seller. The order submission confirms the buyer’s intent to purchase and the seller’s intent to fulfill the order under these terms.

If a clear error has occurred in the listing (e.g. a obvious typographical mistake in price or product details), or an error in the buyer’s order details, and one party knew or should have known about the error, then the party affected by the mistake is not bound by the agreement. In other words, if an obvious mistake occurs in the offer or acceptance, either party may void the transaction provided the error and the other party’s knowledge of it can be demonstrated.

5. Payment

Unless otherwise agreed, the seller will not charge the buyer until the product is ready to ship. TheMF LCC accepts major credit and debit cards through the Stripe payment processor (Visa, MasterCard, American Express, etc.). When paying by card, the seller may place an authorization hold for the purchase amount at the time of order; the card is typically charged on the same day the item is shipped.

All payments are processed securely. The buyer must provide valid payment information and by placing an order authorizes the seller (or its payment processor, Stripe) to charge the specified amount. If the payment is declined or cannot be processed, the order may be cancelled.

Note: Buyers under the age of 18 should only transact with the consent of a parent or guardian. TheMF LCC does not knowingly collect payment from minors without appropriate authorization (the original terms note that under-18 buyers could not use certain payment methods).

6. Delivery

Delivery Time and Method: TheMF LCC will arrange shipment of the goods to the address provided by the buyer. All orders are shipped via standard postal services (regular post) unless otherwise specified. If no specific delivery time is stated during checkout, the seller will dispatch the goods without undue delay and no later than 30 days from the order date. Delivery is generally expected within a reasonable timeframe, but may vary by destination. The goods shall be delivered to the buyer (or the buyer’s designated recipient); any alternative delivery arrangements must be agreed upon separately.

Transfer of Goods: Delivery is considered complete when the buyer or their representative has physically taken possession of the item. At that point, the goods are deemed delivered.

If a package is unclaimed or cannot be delivered due to the buyer providing incorrect address information, the buyer should contact the seller to arrange re-delivery (additional shipping fees may apply in such cases). The seller is not liable for delays or failures in delivery caused by the buyer’s failure to provide accurate information or to retrieve the package.

7. Risk of Loss

All shipments are insured or otherwise guaranteed by the seller until delivered. The risk of loss or damage to the goods passes to the buyer once the buyer (or their representative) has received the goods in accordance with the agreed delivery terms. Until that point, the seller bears the risk for the product during transit. After delivery, the buyer is responsible for safeguarding the goods.

(In practical terms, this means if the product is lost or damaged in transit before you receive it, that is the seller’s responsibility; if loss or damage occurs after you have received the item, it is the buyer’s responsibility.)

8. Right of Withdrawal (Cancellation)

Unless one of the legal exceptions applies, the buyer has a statutory right to withdraw from (cancel) the purchase within 14 days after receiving the goods. This “cooling-off” period is provided in accordance with applicable consumer protection laws for distance sales. To exercise the right of withdrawal, the buyer must clearly inform the seller (for example, by email) within 14 days of receiving the product that they wish to cancel the purchase. (If the 14th day falls on a weekend or holiday, the deadline is extended to the next working day.)


The Right of Withdrawal allows the buyer to return the product for a refund of the purchase price. Key points regarding withdrawal rights include:

  • The buyer should send the cancellation notice in writing (e.g. via email) to have proof of exercising the right in time. We recommend using the withdrawal form or email for evidence.
  • The buyer must return the goods within 14 days after notifying the seller of the withdrawal. The items should be sent back in their original condition, with all components included, if reasonably possible.
  • The buyer generally bears the direct cost of returning the item, unless the seller has stated otherwise or is required by law to cover return shipping. The seller will not charge any restocking fee or other fee for the buyer’s exercise of the right of withdrawal.
  • The buyer may inspect the product to the extent necessary to assess its nature, characteristics, and functioning (similarly to how one might examine a product in a store) without losing the right to withdraw. However, if the item is used or handled beyond what is necessary to make such an assessment, the buyer can be held responsible for any diminished value of the goods.
  • Upon a valid withdrawal, the seller will refund the purchase price (including standard outbound shipping cost, if any) to the buyer without undue delay. The refund will be processed no later than 14 days from the day the seller was informed of the buyer’s decision to withdraw. Please note, the seller reserves the right to withhold the refund until the returned goods are received back or the buyer provides proof of having returned the goods, whichever comes first.

No Refund Policy (Outside Legal Rights): Apart from the above-described right of withdrawal and warranty claims for defective products, TheMF LCC does not offer returns or refunds for change-of-mind or dissatisfaction after the 14-day withdrawal period. All sales are considered final once this period lapses (this does not affect your rights if a product is faulty or not as described).

9. Delay and Non-Delivery

TheMF LCC is committed to delivering orders in a timely manner. However, if the seller fails to deliver the item or delivers it significantly later than agreed, and this is not due to any fault of the buyer (for example, it’s due to an issue on the seller’s side or logistics), then the buyer has certain remedies available under consumer law:

  • Withhold payment: If payment has not yet been collected, the buyer may withhold payment for the order as long as the delay persists.
  • Demand fulfillment: The buyer can demand that the seller completes the transaction and delivers the product as soon as possible.
  • Cancel the purchase: After giving the seller a reasonable additional time to deliver, the buyer can choose to cancel (rescind) the agreement and claim a refund. In some cases of extreme delay or where timely delivery was essential, the buyer may cancel immediately without waiting (e.g. if the seller refuses to deliver or if the delivery date was critical and was stated as such when ordering).
  • Claim compensation: The buyer may claim compensation for any provable loss caused by the delay or non-delivery.

Before cancelling for late delivery, the buyer should normally notify the seller of a new reasonable deadline to fulfill the order, giving the seller a chance to remedy the delay. If the seller does not deliver within that extended period, the buyer can terminate the purchase. If timing was of the essence (for example, delivery needed before an event or a specific date) or if the seller has stated they cannot deliver, the buyer may cancel without providing an extension.


In any case of order cancellation due to delay or non-delivery, the buyer is entitled to a full refund for undelivered goods.


Limitations: The seller is not liable for delays or failure to deliver if it is caused by circumstances beyond the seller’s control that they could not reasonably foresee or avoid (for example, natural disasters, wars, severe supply chain disruptions, etc.). Such unforeseen events (force majeure) that prevent delivery within the agreed time may excuse the seller from liability for compensation. The seller will inform the buyer as soon as possible of any such situation and the expected impact on delivery.

10. Defective Products and Complaints

If the product is delivered with a defect or fault that is not due to the buyer (e.g. manufacturing defect, damage in transit, or the item does not match the description), the buyer has the right to make a complaint and seek a remedy under these terms and applicable law.

Notification of Defects: The buyer should inspect the goods upon receipt. If a defect is discovered, the buyer must inform the seller within a reasonable time after noticing the problem. Complaints made within two months from the time the defect was discovered are always considered timely. In any event, the buyer cannot raise a defect claim later than 2 years after taking possession of the product (or up to 5 years if the product is meant to last significantly longer), as per consumer protection regulations.

To notify the seller of a defect, the buyer should describe the issue and provide relevant order information (order number, product name, etc.). It is strongly recommended that complaints be made in writing (for example, via email),

both for documentation and efficiency. The seller will acknowledge the complaint and guide the buyer through the next steps.

Buyer’s Remedies for Defective Goods: If the product is indeed defective or not as advertised (and the cause is not something attributable to the buyer), the buyer may be entitled to one or more of the following remedies, depending on the situation:

  1. Repair or Correction: The buyer can demand that the seller fixes the defect if possible (e.g. by sending a replacement part or providing a repair).
  2. Replacement: The buyer can demand delivery of an equivalent new item free from defects, if a repair is not feasible or the defect is significant.
  3. Price Reduction: If the defect is minor or cannot be fully remedied, the buyer may choose to keep the product but at a reduced price, receiving a partial refund proportional to the defect’s impact.
  4. Cancellation (Refund): In cases of significant defects, the buyer can return the product and cancel the purchase, receiving a refund of the purchase price.
  5. Compensation: The buyer can claim compensation for any loss incurred due to receiving a defective product (for example, the cost of returning the item, or other damages caused by the defect), provided that the loss is documented and not too remote.

The buyer may initially choose between repair or replacement of the item. The seller has the right to refuse the chosen remedy if it is impossible or would impose disproportionate costs compared to an alternative remedy. In such cases, the buyer may have to accept the alternative remedy (e.g., a replacement instead of repair or vice versa) as long as it is provided within a reasonable time and without significant inconvenience.

Any repair or replacement will be carried out within a reasonable time and without cost to the buyer. The seller is generally not allowed more than two attempts to fi x the same defect before the buyer can pursue another remedy (such as refund or price reduction).

If the buyer opts to terminate the purchase (refund) due to a defect, the seller may ask for the product to be returned. In that event, the seller will bear the return shipping cost for defective merchandise (or provide a prepaid return label), since the issue is on the seller’s side.

11. Seller’s Rights in Case of Buyer’s Default

The buyer is obligated to provide correct information and make timely payment for orders. If the buyer fails to pay for the product or otherwise does not fulfill their obligations under the agreement (and the failure is not due to the seller or circumstances on the seller’s side), the seller has certain rights to remedy the situation:

  • Withhold goods: The seller can withhold dispatch or delivery of the goods until payment is made (if the order has not been shipped yet).
  • Demand fulfillment: The seller can require the buyer to uphold the purchase and pay the outstanding amount (the buyer remains liable for the purchase price).
  • Cancel the sale: If the buyer does not pay despite a reminder and a reasonable additional grace period, the seller may cancel the purchase. (The seller will not cancel if the buyer has already paid in full.) In case of cancellation due to non-payment, the seller may resell the item.
  • Claim compensation: The seller can claim damages/compensation from the buyer for any losses incurred due to the breach (for example, additional shipping or handling costs, storage fees for unclaimed goods, etc.).
  • Charge interest on late payment: If payment is late, the seller may charge late interest as permitted by law from the due date until payment is received.
  • Debt collection fees: If the seller has to engage a debt collection service or legal process to recover the payment, the buyer may be held liable for the associated debt collection fees, to the extent allowed by law (after proper notice).
  • Fees for uncollected goods: If the buyer fails to accept or pick up the goods causing them to be returned to the seller, the seller can charge the buyer a reasonable fee to cover the cost of shipping and handling the unclaimed goods. This fee will not exceed the actual costs the seller incurred for the delivery and return. (Such a fee will not be charged to a buyer under 18 years old.)

Any fees or interest imposed due to the buyer’s default will be in accordance with applicable laws and not excessive or punitive in nature. The seller will provide notice before escalating to formal debt collection, and the buyer will have an opportunity to cure the breach (e.g. pay the amount due) before further steps are taken.

12. Guarantee and Warranty

Unless otherwise expressly stated, TheMF LCC does not offer any additional commercial guarantee on products beyond the manufacturer’s warranty (if any) and the rights afforded by law. If the seller or manufacturer does provide a specific guarantee for a product, this will give the buyer additional rights on top of their legal rights; it will not replace or reduce the buyer’s rights to claim for defects or delays under sections 9 and 10 above.

In summary, any voluntary warranty is intended to enhance the buyer’s protection, not limit it. The buyer can always exercise their rights under consumer protection laws regardless of any extra guarantee.

13. Personal Data

Data Controller: The seller (TheMF LCC) is the data controller for personal information collected in connection with purchases. We respect your privacy and handle personal data in compliance with relevant data protection laws. Unless the buyer explicitly consents to additional uses, the seller will only collect and use personal data that is necessary to fulfill the obligations of the sale (such as processing payment, fulfilling the order, and delivering the goods).

This means we will collect details like your name, contact information, shipping address, and payment details to process your order. Your information will only be shared with third parties as needed to complete the transaction – for example, with payment processors (Stripe) to handle payment, and shipping carriers/postal services to deliver the package, or as required by law.

We will not disclose your personal data to others for marketing or unrelated purposes without your consent. For more information on how we handle personal data, please refer to our Privacy Policy page.

14. Conflict Resolution

If the buyer has a complaint regarding the purchase, we encourage contacting the seller as soon as possible so that we can address the issue. Complaints should be raised within a reasonable time after the buyer noticed the problem, preferably in writing (e.g. via email), especially for issues regarding delays or defects. The seller and buyer shall attempt in good faith to resolve any dispute or disagreement through friendly negotiation.

In the event an amicable resolution cannot be reached, the buyer may seek further assistance or mediation through relevant consumer protection authorities or take other legal action. TheMF LCC will comply with applicable dispute resolution regulations. For example, consumers in some jurisdictions may be entitled to approach an alternative dispute resolution entity or use an online dispute resolution platform to facilitate a settlement.

Ultimately, if a dispute cannot be resolved, either party may pursue claims or defenses in accordance with their rights under the law. (As the company is based in the USA, any legal proceedings may, unless otherwise provided by consumer law, fall under the jurisdiction of the courts in the State of Wyoming, USA. However, consumers may also have rights to initiate claims in their home country under local consumer protection laws).
